INTRODUCTION

JOB PURPOSE

The Senior Counsel, Brand Protection will be responsible for all IP enforcement matters throughout EMEIA.

The position is for someone who is passionate about intellectual property law and brand protection. The candidate must be thoughtful, proactive, and have a strong attention to detail. They must have excellent communication, organization and analytical skills. The candidate must have strong interpersonal skills and be able to communicate effectively, both verbally and in writing, with a wide audience. The candidate should have the ability to manage time effectively, work in a fast paced dynamic environment, be a self-starter, and take pride in their work product. The candidate must be service oriented and have a positive attitude. The right person will have the ability to function collaboratively as a team and independently. Lastly, the candidate should have a global perspective and desire to be part of a global team.

RESPONSIBILITIES

  • Oversee and lead brand protection efforts, including identifying infringers, initiating and responding to potential infringement and counterfeit concerns, sending cease and desist letters, negotiating resolutions, filing takedown requests and other pre litigation and litigation activities throughout EMEIA.
  • Provide legal advice relating to and in support of the company's anti-counterfeiting and brand protection activities and ensure compliance with internal policies and protocols.
  • Manage customs and criminal enforcement activities in EMEIA, liaising with law enforcement authorities and external counsel on enforcement matters and receiving updates and providing instructions on existing and new matters;
  • Manage and manage all civil enforcement matters, including cease and desist letters, settlement agreements and related correspondence;
  • Coordinate regional brand protection activities, including the management of external counsel and service providers as appropriate.
  • Manage and engage in online enforcement, including working with service providers, industry collaborations and online platforms and initiating UDRPs and civil actions as appropriate.
  • Partner with the business to implement and support business strategies and programs as needed


PERSONAL PROFILE

  • Qualified lawyer with minimum of seven years' legal experience at a law firm and/or corporate in-house experience with significant emphasis on intellectual property and/or anti-counterfeiting.
  • Extensive experience with litigation.
  • Thoughtful, proactive, strong attention to detail.
  • Ability to work independently while being a team player to bring a positive attitude to the workplace.
  • Strong leadership skills and an open and caring attitude.
  • Strong organizational skills and ability to juggle multiple tasks.
